NOT AFFORDABLE

This bill prohibits the use of algorithmically set prices using personal data ("surveillance pricing") and threatens to take away consumers’ access to widely accepted and expected personalized discounts and loyalty and rewards programs offers. It also creates a new private right of action with no right to cure. 

While the bill exempts some discounts, like sales events (25% off this weekend), coupons distributed publicly, and store-wide promotions ("buy one, get one"), it will jeopardize the following discounts for New York consumers:

• Personalized Deals

• Personalized Restaurant Promotions

• "We Miss You" Win-Back Offers

• Hotel Loyalty Personalized Rate Discounts

• Browse-Abandonment Offers

• Rewards Programs Challenges

• Milestone/Birthday Offers

• Military, Seniors, Teacher & Employee Discounts (*customer must self-identify to receive promotion and cannot be automatically applied)
