NOT AFFORDABLE

The New York Health Information Privacy Act (NYHIPA) laudably attempts to protect consumers’ sensitive health data, but this bill goes far beyond consumer data protection laws of other states and will limit consumer access, jeopardize growth, and increase costs for all. By introducing a vastly different privacy regime than those adopted in other states, NYHIPA’s operational impact would raise compliance costs across industries, create new affordability challenges for New Yorkers, and undermine service continuity at a time when many sectors and small businesses are operating under tight margins.
